The town council may grant exceptions to the provisions of section 22-315(c)(1) (pertaining to liability insurance requirement limits) and/or section 22-315(e) (pertaining to hours of event), taking into account the general public health,
safety and welfare associated with the request for exception, as well as the liability
risk and the applicant's ability to pay. When the town council considers requests
for exceptions, the town council shall base the decision on the factual circumstances
presented and decide the specific request on its merits and may not discriminate on
the basis of race, color, religion, creed, political ideas, sex, age, marital status
or physical or mental disability unless based on a bona fide liability risk, general
welfare, health or safety reasons.
