§ 16-289. Exceptions to curfew for certain activities.

  • (a)

    The following, and only the following, circumstances shall constitute an exception to the curfew regulations established in this division:

    (1)

    When the minor is accompanied by a parent, legal guardian or adult acting with or by the express written authority of the parent or legal guardian.

    (2)

    When the minor is directly engaged in performing a specific lawful errand for a parent, legal guardian or adult acting and by the express written authority of the parent or legal guardian. The minor must have the written authorization in his possession at the time they are in public places during curfew hours.

    (3)

    When the minor is engaged in legal employment or is traveling directly to or from his legal employment and the minor is within 15 minutes time of the commencement or end of the employment shift.

    (4)

    When the minor is attending religious or school activities, meetings or events and is either at the event or within 15 minutes of the commencement time or end of the event and the minor possesses a written authorization of the parent, legal guardian or adult in charge of the event.

    (5)

    When the minor is attending entertainment events such as school authorized youth dances (excluding dances in bars, taverns and night clubs where beer or liquor is sold for on-premises consumption) theater, concert, all-night charity fund raisers, such as all-night walk-a-thons, or sporting events. The holding of such events during curfew hours must be previously approved by the town council, sponsored by a public or governmental organization, must be continuously supervised by adults and may not be a privately sponsored event.

    (b)

    When returning home or to his hotel, motel or other place of rest and repose by a direct route from any activity, meeting, event or legal employment identified in this section, the person shall be allowed 15 minutes after ending time of the activity identified in this section to reach his destination and such travel must be in a direct route from the event to the home or other place of rest or repose. In the event that the minor works or attends an authorized event out of town, he is allowed 15 minutes within the town to reach his home; however, the burden of proof is on the minor to prove his authorized employment, activity or meeting at the time of cessation.
